SHIPPING POLICY

Shipping Deadlines
Orders received by us (for in-stock product) before 12 noon (Pacific Standard Time) will be shipped the same day. Orders received (for in-stock items) after 12 noon will ship within one (1) business day of receipt.

Carriers
RAX ships by UPS, USPS, FEDEX, DHL and numerous carriers for larger orders. Unless otherwise specified, orders will be shipped by standard UPS Ground service. Please note that certain products classified HAZMAT or ORMD will not be shipped by air under any circumstances.

Freight Costs
RAX will add freight charges to the customer's invoice for all orders, unless otherwise specifically agreed to before the order is shipped.

RAX offers a "Bill to Third Party" option for UPS, FEDEX and DHL services only. Parcels can be shipped and the shipping charges will be billed directly to the customer's account. All address correction fees assessed by the freight carriers will be billed to the customer's account.

Parcel Insurance
RAX will insure parcels at the published carrier insurance rate and bill the customer unless otherwise instructed by the customer in writing. Should the customer choose to self insure, RAX has no liability for lost or damaged parcels, once the shipment leaves any of our warehouses.

International Shipments
Please note that certain products distributed by RAX are not available for export. Check with your sales representative for further details.

RETURN POLICY

RAX customers must obtain a Return Authorization number before attempting to return any merchandise to RAX. Certain manufacturers insist that defective or damaged merchandise be returned directly to them, so please consult a RAX representative to determine where the return should be shipped.

RAX will not accept any returned merchandise without a valid RA#. To obtain an RA #, call 1-800-367-4729 or email us at info@raxusa.com. A customer service representative will give you an RA # that must be clearly indicated on the outside of the return parcel, as well as on any paperwork needed for the return.

RAX will not be obligated to accept any returns submitted more than 60 days after initial shipment of product(s) to customer, excluding returns of defective items. RA #'s have a validity period of 30 days from the date of issue.

Restocking Fees
Non-defective merchandise returned to RAX for any reason other than an incorrect shipment of product(s) will be subject to a 15% restocking fee. Product(s) must be received by us in original condition and within 30 days of the original shipping date. Any returned items that do not meet these criteria will not be accepted for return.

PRIVACY AND SECURITY

RAX is committed to your privacy and guards your data carefully. We realize that your company information may be considered sensitive in nature and understand the importance of protecting the privacy of all submitted information. RAX may collect some personally identifiable information about you and/or your company while you are visiting this website. Such information would include your name, telephone number, e-mail address or professional data. We use this information to help maintain accurate records, answer inquiries, promote efficiencies within our company and to help make our website useful to you. RAX will not share this information with any outside agencies and uses reasonable precautions to ensure the security of personal information that you have disclosed to us.

CUSTOMER ACCOUNT, PASSWORD, AND SECURITY
If a particular RAX Web Site, along with any product or service offered on any RAX Web Site (each a "RAX Site/Service", and collectively "RAX Sites/Services") requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information, as prompted by the applicable registration form. You then will choose a password and a user name. All registered parties are entirely responsible for maintaining the confidentiality of their password and account. RAX reserves the right to change the terms, conditions, and notices under which the RAX Sites/Services are offered; including, but not limited to, the charges associated with the use of the RAX Sites/Services. You are responsible for regularly reviewing these terms and conditions and additional terms posted on particular websites. Your continued use of the RAX Sites/Services constitutes your agreement to all such terms, conditions and notices.

RAX MAKES NO WARRANTY THAT ANY RAX SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.

TERMINATION/ACCESS RESTRICTION


RAX reserves the right, in its sole discretion, to terminate your access to any or all RAX Sites/Services and the related services or any portion thereof at any time, without notice.

RAX may also terminate or suspend your access to RAX Site/Service(s) due to inactivity, which is defined as failing to log into a particular service for an extended period of time, as determined by RAX. Upon termination of access to a RAX Site/Service, your right to use the RAX Site/Service immediately ceases.

RAX shall have no obligation to maintain any content or to forward any unread or unsent messages to you or any third party.

GENERAL
The laws of the State of California, U.S.A., govern this agreement. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in San Diego County, California, U.S.A. in all disputes arising out of or relating to the use of the RAX Sites/Services. You agree that no joint venture, partnership, employment, or agency relationship exists between you and RAX as a result of this agreement or use of the RAX Sites/Services. You agree to indemnify and hold RAX, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of or conduct on the RAX Sites/Services. RAX reserves the right to disclose any personal information about you or your use of the RAX Sites/Services, including its contents, without your prior permission if RAX has a good faith belief that such action is necessary to: (1) conform to legal requirements or comply with legal process; (2) protect and defend the rights or property of RAX or its affiliated companies; (3) enforce the terms or use; or (4) act to protect the interests of its members or others. RAX's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of RAX's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the RAX Sites/Services or information provided to or gathered by RAX with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and RAX with respect to the RAX Sites/Services and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and RAX with respect to the RAX Sites/Services. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
